Please read these Terms of Service (“Terms”) carefully before using Flexi Archiver (the “Service”), a web-based data archiving platform offered by Tyche Softwares, located at 651 North Broad Street, Suite 201, Middletown, DE 19709.
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.
1. Service Overview
Flexi Archiver is a subscription-based SaaS product that enables eCommerce store owners to offload, store, and manage historical order and customer data from their online store in a secure cloud database. The Service provides the ability to restore or delete archived data on demand.
2. Account Registration
To access and use the Service, you must register an account and provide accurate, complete, and up-to-date information. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.
3. Subscription and Billing
- Flexi Archiver is available as a subscription-based service, billed either monthly or annually, depending on your selected plan.
- You may cancel your subscription at any time through your account dashboard. Upon cancellation, you will retain access until the end of your billing period.
- Unless canceled, your subscription will automatically renew at the current rate.
- A 14-day free trial may be offered, after which billing begins unless canceled beforehand.
4. Refund Policy
- Refunds are available within 30 days of your first payment.
- No refunds will be provided after 30 days unless required by law.
- Payment processing fees are non-refundable.
- Refunds do not apply to renewal charges or upgrade/downgrade adjustments.
5. Use of the Service
By using Flexi Archiver, you agree:
- To store only lawful and non-malicious data.
- Not to use the platform for storing or distributing sensitive financial information, illegal content, or personal data without proper consent from data subjects.
- That you are solely responsible for the data you upload and manage through the Service.
6. Data Storage & Security
- Your archived data is stored as-is in a secure cloud database located in New York, USA.
- We keep your archived data safe using strong encryption (Advanced Encryption Standard) and secure storage practices.
- You have full control over restoring or permanently deleting archived data via your dashboard.
- Tyche Softwares will not access your data unless required for technical support or legal obligations.
7. Data Retention
Archived data will remain in your account until you delete it. Tyche Softwares will not delete your data without your explicit instruction, except:
- When required by law or regulation
- If your account is terminated due to policy violations
8. Account Suspension or Termination
We reserve the right to suspend or terminate your account if:
- You violate these Terms
- Payment fails or your subscription lapses
- Your usage poses a security, legal, or performance risk
In the event of account suspension or termination, you may lose access to your archived data. We recommend exporting or restoring your data before cancellation.
9. Intellectual Property
Flexi Archiver and all related intellectual property (design, software, branding, etc.) are owned by Tyche Softwares. You may not duplicate, reverse-engineer, or redistribute any part of the Service without our written permission.
10. Limitation of Liability
Flexi Archiver is provided “as is.” We do not guarantee uninterrupted or error-free access. Tyche Softwares is not liable for:
- Any loss of data due to incorrect use of the restore/delete functions
- Data breaches arising from third-party platforms or your failure to secure your account
- Damages from service interruptions or integration errors
Total liability for any claim shall not exceed the amount paid for the Service in the preceding 12 months.
11. Third-Party Services
The Service may integrate with third-party platforms (e.g., eCommerce stores, analytics tools). You agree that we are not responsible for the privacy practices or content of those services. Use of third-party integrations is at your own risk.
12. Price Changes
We may update pricing or service plans at our discretion. Advance notice will be provided via email or dashboard notifications. Continued use of the Service after price updates constitutes acceptance of the new terms.
13. Modifications to Terms
Tyche Softwares reserves the right to modify these Terms at any time. Updates will be posted on our website or in-app dashboard. Your continued use of the Service after such changes signifies your acceptance.
